Terms and Conditions of Use

1. CONCLUSION OF CONTRACT AND DELIVERY OF GOODS

1.A Our contracts are accepted via www.hierarchyswiss.ch exclusively in German, French and English. When ordering Hierarchyswiss articles, your contractual partner is Hierarchyswiss Switzerland.

1.B When ordering a partner product, you place a binding order for the items in the shopping cart. The receipt of your order is immediately confirmed by email after placing your order. It is important to note that the items ordered will be delivered as soon as we have received payment of the full purchase price plus the shipping costs.

1.C You agree that Hierarchyswiss claims for payment of the purchase price of items via the Hierarchyswiss payment intermediaries.

1.D Note that we are not liable to delivery of goods ordered if you have properly ordered the goods from us, but have Not been delivered correctly or on time. We are not responsible for the lack of product availability and we will inform you as soon as possible in such a situation. In the case where the goods are subsequently unavailable, we will reimburse you for payments already made less cost of transportation.

1.E  We do not take any risk of having to procure an ordered product. This also applies when ordering products that are defined only in terms of their form and features. We are only obligated to supply goods and items that we have in stock and purchased from our suppliers. Our inventory includes our goods and those of our partners. We deliver orders within Switzerland. Our deliveries take place from Monday to Friday, excluding public holidays. On normal bases, good arrive within 3 to 5 business  days after confirmation and receiving of payment on our side. Deliveries usually take place via Post AG.

2. PRICES, SHIPPING CHARGES, AND EXPRESS SHIPPING

2.A The prices referred to in the deal at the time of the order are appropriate. The prices listed are final prices, and include the statutory value added tax.

2.B We cover the shipping costs, except for Express Deliveries.

2.C Please it should be noted that not Express Deliveries are not available to all orders. Feel free to contact us when you need Express Delivery. If the specified delivery time is extended, the delivery costs will be refunded to you.

3. PAYMENT

3.A   At the moment, our payment methods are; prepayment, credit card and PayPal. We reserve the right not to accept a certain payment method and to refer to other payment methods. We only accept payments from accounts in Switzerland and within the European Union ( EU) and you cover the transaction costs.

4. NO WARRANTIES

Hierarchyswiss makes no express or implied representation or warranties of titles, contents or freedom from malicious programs in the site. Hierarchyswiss does not warrant any information accuracy, completeness, or freedom of defects.  We do not take any responsibility of loss due to use, loss of data and costs of any servicing repair of equipment and/or software associated, in connection with this site. We are not responsible for any liability or damages as a result of child or children activities in connection to www.hierarchyswiss.ch.

5. DISCLAIMER

5. A The material on this site may contain inaccuracies or typographical errors. Hierarchyswiss is not responsible for any loss or damage caused by reliance on a user’s website. It is your responsibility to evaluate the information available on this site and other content. This site and the information contained on this site may be subject to change without notice.

5.B Hierarchyswiss has the right to cancel or refuse an order without giving you reasons. In this case, if your credit card has already been charged, we will initiate a refund process. We may suspend or terminate your account without notice or give you any reason at any time.

5. C When an order is placed, the shipment is delivered to the purchaser. All purchases on this site are made according to a shipment contract. Our recognisability of delivery ends when the good to handed over to the curia agency. You are responsibility to assess and claim for damages and/or lost shipments with the carriers.

5.D  Hierarchyswiss is not liable to Loss or damages as a result of contractual, tort, or any other theory, arising out of or in connection with the use, inability to use or performance of information, products, and materials on  www.hierarchyswiss.ch and our social media sites.

5.E Some styles or colours of the products on this site may not be available. Due to individual monitoring, the actual colours of the products shown cannot be guaranteed. We’ve made every effort to reflect the colours and brand name on the products on this site. Also, designs, colours, and prices can change without notice.

6. RIGHT OF RETURN

All purchases of Hierarchyswiss articles at www.hierarchyswiss.ch, are granted a voluntary right of return for a period of 15 days from receipt of the goods. You can then withdraw from the contract by sending the goods back to us within 15 days after receiving the goods. Timely dispatch is required to meet the deadline. The goods should not be used, and you make sure that they are returned complete and undamaged.

We expect you to send the goods back to us in their original packaging including any instructions and the undamaged seal. If these requirements are not met, the return of the goods can be refused.

Hierarchyswiss is not responsible for the return costs.

The right of return does not apply to the purchase of gift vouchers. Please send goods to Hierarchyswiss CH-3072 Ringstrasse 3.

We would like to inform you that our products are of first-grade high-quality leather. It is very normal to have some slight scratches which turn to disappear with time as the leathers are self-recovering. The size of the product can be of very little difference compared to the description on the website since they are handcrafted.

7. REPAYMENTS

If you have paid by PayPal or credit card, the refund will be made directly to the related PayPal or credit card account.

8. LEGAL LIABILITY AND ADDITIONAL INFORMATION

8.A The Swiss statutory warranty for defects applies. Hierarchyswiss reserves the right to deliver a defect-free replacement to a buyer in the case of identified defects in the purchased product.

9. APPLICABLE LAW AND JURISDICTION

APPLICABLE LAW AND JURISDICTION

9.A Swiss law applies to all legal transactions or other legal relationships with Hierarchyswiss. The UN Sales Convention (CISG) and any other international agreements are not taken into consideration.

9.B Note that the place of jurisdiction of a consumer is the consumer’s Swiss domicile. In business dealings with merchants, our place of business is agreed as the place of jurisdiction for all legal disputes about these terms and conditions and individual contracts concluded under their validity, including actions on bills of exchange and checks.
